(a) Customer/You: Person(s) details as set out on the order form.
(b) Goods/ item: Items ordered as set out on the order form.
(c) The Company, we, us, and the site: refers to doorchic and her parent company John Monaghan Ltd.
(d) Working day: Every day except weekends and bank holidays.
(e) Special order items: Goods not normally carried by doorchic, and are ordered in accordance with a customer request via the on line order form, or any other medium of contact.
(f) DSR: Distance selling regulations.
(a) All orders through doorchic are subject to the terms and conditions set out below.
(b) All statuary rights are unaffected.
(a) We cannot guarantee that the appearance and/or colour of products exactly
reproduce the appearance of the physical products themselves, and therefore goods may differ slightly.
(b) We cannot guarantee that goods purchased from us will exactly fit existing fittings of similar dimensions, and cannot accept responsibility for any differences which may occur.
(C) We cannot guarantee that goods supplied of the same product on separate shipments will be from the same supplier as these may be changed for buying purposes, to keep our prices down and afford value for money to our customers, or manufacturers discontinued product lines that are re-sourced. Therefore they may differ slightly in colour tone or specification, though every effort will be reasonably made to avoid this.
(4) Price and payment
(a) Price of goods will be priced quoted at the date of order and will include VAT @ 20%.
(b) Delivery charges may be applicable to each individual order and are dependent on delivery location and total order value. Delivery charges are fully visible in the shopping basket prior to placing the order. For full details of all carriage charges please see the 'delivery charge table in the 'How to buy' section.
(c) We reserve the right to increase prices before the date of delivery, to reflect any increase in cost incurred by ourselves, due to factors out of our control. The customer will be notified at this point and will be entitled to cancel the order.
(a) The customer is responsible for ensuring all details are correct when filling in the order form and all related fields.
(b) An order has not been accepted until we have received payment in full, after which you will receive confirmation of your order via e-mail and an approximate delivery date (see section 7).
(c) An order is deemed to be an offer by the customer to purchase goods from us and therefore legally binding and if misused in any way, the customer will be liable for any costs incurred.
(d) We have the right to refuse any order without explanation.
(a) All payments are secure using Paypoint.
(b) Payments can be made using all major Credit and Debit cards, and by placing the order you give us the right to debit the named account for the amount stipulated on the order form.
(c) Once full payment is received we will begin to process the order.
(d) The title of goods will pass to the buyer upon receipt of payment in full.
(e) All purchases made via the website are made in GBP.
(f) ALL payments must be made in GBP.
(g) Payment can be made by cheque or bank transfer. If you wish to pay by bank transfer please contact us for details. If you require a proforma invoice for this facility please let us know.
(a) We are only able to deliver goods to the UK at the moment, but if there are items of special interest, please feel free to contact us where we can discuss your requirements.
(b) All goods will be delivered to the address detailed on the order form, unless other arrangements have been made, using a carrier nominated by doorchic.
(c) We aim to dispatch all goods within 5 working days, and customers will be notified by e-mail (supplied by the customer at the point of order) of the dispatch of their goods. Please check your order immediately, and notify us of any errors.
(d) Delivery dates are, however, approximate as we cannot accept liability for delays occurring beyond our control. If problems do arise then the customer will be notified and the customer has the right to cancel without obligation.
(e) The risk of loss or damage passes to the customer upon delivery of the item(s).
(f) Multiple order items will not be dispatched until all items are available. If a particular item is urgent we will endeavor, through our customer service team, to make special arrangements. An additional delivery charge will be applied and notified at the time of arrangement.
(g) You can cancel at any time prior to dispatch of your order by e-mail, fax or letter. Our address can be found in the contact us section or e-mail email@example.com. If cancellation occurs after dispatch, or a special order item has been ordered then the customer will be liable for all delivery charges incurred by the company (standard carriage charge and £2.00 re-stocking fee) and, for special order items, a re-stocking fee applied based on the following categorised system:- Category A - 20% of product value, Category B - 25% of product value and Category C - acceptance of returns and/or re-stocking fee assessed on an order to order basis. Please note that charges applied are only those incurred by the company from our supplier.
(h) We endeavor to keep stock to provide a full service to our customers. If, however, we do encounter an out of stock situation, and we cannot fulfill our commitment to you, then we will endeavour to notify you within 48 hours as delays can occur out of our control when dealing with third party suppliers.
(i) We dispatch all goods via a nominated courier, or by other recordable methods of delivery where a signature will be required for the goods, unless you specify otherwise in 'special instructions' area in the shopping basket.
(j) We can not guarantee exactly on what date or time the items will be delivered, unless special arrangements have been made with a member of our customer service team. A confirmation of dispatch e-mail will be sent to confirm that the item(s) have been dispatched and all goods addressed to the UK mainland are sent for next working day delivery. If delivery has not been made within 5 working days of the confirmation of dispatch e-mail please contact a member of our customer service team who will be able to help with your enquiry. Claims for non delivery will NOT be accepted after 28 days from notification of the dispatch e-mail.
(K) We reserve the right to request any subsequent delivery cost if the order is returned to us due to a failed delivery or a change of address where delivering depots are altered to accomodate a change of address request. If a re-delivery is requested after an item has been returned to us by our courier following a lack of response to 3rd party contact then a re-delivery charge is applicable for UK mainland customers. For other areas you will be notified whilst re-arranging delivery details.
(8) Return of goods
(a) You must inspect your goods immediately upon receipt of your order, to ensure your complete satisfaction. If you encounter any incorrect, defective, or missing pieces you must notify us within 3 working days of receipt of your order. Upon investigation, and liability is accepted by us we will offer to exchange the product(s) or a full refund will be offered, as long as the item(s) is returned in the original packaging with all manuals/instructions enclosed.
(b) If you are not satisfied with the goods or cancel your order for any reason you must return the item(s) to us. In accordance with DSR you should notify us in writing (e-mail, fax or letter accepted) within 7 working days of receipt of the goods, and will be liable for charges as laid out in 7(g), and all delivery charges incurred in the process dependent on the location of the delivery. Please see carriage charge section in the 'How to buy' category. Goods should be returned in their original packaging and in a resaleable condition, with all documentation originally supplied with the goods.
(c) Your intention to return goods or cancel the order will not be accepted over the telephone and must be made in writing by e-mail, fax, or letter.
(d) To return items to us please notify a member of our customer service team in writing. We will then issue a returns form, allocate a return number, and discuss the best method of return. Returns WILL NOT be accepted without a returns form and recognised return authorisation number.
(e) Refunds will be paid within 30 days of receipt of the returned order, assuming that points covered in 8 (b) have been met.
(a) We offer a full 12 month guarantee, but cannot accept liability for damage caused due to faulty fitting, or abuse of the item. Your statutory rights are unaffected.
(10)Limitation of liability
We cannot be held liable, where our performance and obligations, set out in the terms and conditions, are affected by:
(a)Act of God, explosion, flood, tempest, fire or accident.
(b) War or threat of war, sabotage, civil disturbance, or requisition.
(c) Acts, restrictions, regulations, bye-laws, prohibitions, or restraints by Government or Local authority.
(d) Import or export regulations or embargoes.
(e) Strikes, lockouts or other industrial actions or trade disputes.
(f) Difficulties in obtaining raw materials, labour, fuel, parts or machinery.
(g) Power failure or breakdown in machinery.
(11) Intellectual property
(a) All materials contained in the website are under copyright and trademarks and brands therein belong to doorchic, John Monaghan Ltd and related suppliers.
(b) Content within the website may be downloaded or copied for the use of non-commercial purposes. Any other than personal use is strictly prohibited without prior agreement, in writing, from the Company.
(a) We reserve the right to alter or discontinue any part of the website without notice or liability.
(b) We will attempt to ensure all information contained in the site in relation to pictures, finishes, and measurements are accurate, but any errors or unintentionally misleading information is purely unintentional and we cannot be held liable.
(c) Terms and conditions can be altered without prior notification, and are applicable at the date of order.
(a) Sites linked, too and from, doorchic are not under the control of the company and therefore we cannot accept any responsibility for their content, or matters arising from their use via a link from doorchic.
